DHS Secretary extends TPS Temporary Protected Status

My fellow brave ones! Once again, I’m back with the weekly summary of what I believe are the most relevant topics on immigration matters for our community.

Extension and Redesignation of Temporary Protected Status for Haiti Announced 

Secretary of Homeland Security Alejandro N. Mayorkas announced today the extension and redesignation of Haiti for Temporary Protected Status (TPS) for 18 months, from August 4, 2024, to February 3, 2026, due to extraordinary and temporary conditions in Haiti. 

 

The reasons for this decision include:  

  • Ongoing violence and insecurity in several regions. 
  • Limited access to safety, healthcare, food, and water. 
  • Vulnerability to flooding, mudslides, storms, and earthquakes. 
  • This redesignation allows approximately 309,000 additional Haitian nationals residing in the U.S. before June 3, 2024, to apply for TPS and related authorizations, provided they meet the eligibility requirements. 

 

For current beneficiaries: 

  • They will retain TPS through February 3, 2026. 
  • They must re-register between July 1, 2024, and August 30, 2024, to maintain their employment authorization. 
  • DHS will automatically extend certain Employment Authorization Documents (EADs) until August 3, 2025. Those with these EADs must re-register to obtain a new authorization valid through February 3, 2026.

This extension does not apply to individuals who were not in the U.S. as of June 3, 2024. The policy of returning individuals who attempt to enter the U.S. without authorization will continue to be enforced.

U.S. Rules Out Increasing Migration Appointments via CBP One App  

Reports from the CBP One app, which is used to request asylum in the United States, indicate that the number of available appointments will not be increased. This means that the current number of appointments will remain unchanged, and there will be no expansion in the appointment slots provided.  

The U.S. government has ruled out increasing the number of migration appointments through this app, citing a lack of budget and resources. We will continue to monitor the situation and provide more information about this app and its operation at the border, as well as its legalities and procedures.

Peru Seeks Visa Exceptions for Minors and Vulnerable Individuals  

Peru is seeking a visa exception for minors and vulnerable individuals. The goal is to allow these individuals, especially children, to receive a visa and enter the country.  

The Peruvian government has informed its citizens about these potential exceptions. The new regulations are expected to take effect on July 2. During this period, the specific requirements for Peruvians wishing to benefit from these exceptions will be reviewed. We will stay updated on this policy and provide more information as it becomes available.

Biden Faces Crisis After Debate, Threatening Reelection Bid  

President Joe Biden must act quickly to calm Democratic panic over his poor debate performance against former President Donald Trump. Following a Texas representative’s call for Biden to step aside, leading Democrats are demanding more transparency about Biden’s health and mental state, as concerns about his reelection campaign grow.  

Biden’s attempts to address the issue have often made matters worse. For example, he joked with donors about almost falling asleep during the debate, undermining efforts to counter claims that he is unfit for office at 81.  

Key Issues:  

  • Debate Impact: The debate highlighted Democratic fears about Biden’s prospects and played into Trump’s claims that Biden is weak and mentally diminished. 
  • Health Concerns: Biden’s team stated he had a cold during the debate but otherwise was healthy. This failed to explain his slow responses and occasional incoherence. 
  • Public Trust: The debate raised doubts about Biden’s ability to complete another term, ending at age 86.

Despite reassurances from his team, Biden faces mounting pressure to demonstrate his capability and campaign with more vigor. The outcome of this crisis remains uncertain, posing a significant challenge to his bid for a second term.

La Lupa Electoral – Supreme Court’s Historic Ruling on Trump’s Immunity 

The Supreme Court issued a historic ruling on Monday granting Donald Trump partial immunity in Special Counsel Jack Smith’s election subversion case, marking a significant victory for the former president in his reelection bid.  

Although the 6-3 decision allows Smith to proceed with resolving the indictment, Chief Justice John Roberts’ majority opinion left many technical issues unresolved. This makes it increasingly unlikely that a trial could start before the November elections.

  • Immunity Granted: Trump achieved more than expected with the court granting him absolute immunity for “core” presidential activities. His discussions with the Justice Department about overturning the election results are covered by this immunity. 
  • Lower Courts’ Role: The case now returns to lower courts to assess whether Trump’s actions were official and thus immune, or private and not. 
  • Impact on Trial: Official acts cannot be used as evidence in a potential trial, complicating Smith’s efforts. Lower courts also cannot consider Trump’s motives, aiding his defense. 

 

Next Steps: 

The case will proceed with more hearings and written arguments, possibly involving witness testimonies and evidence debates in District Judge Tanya Chutkan’s court. New appeals could cause further delays.
